Terms of Service for AgentForest

Welcome to AgentForest! These terms and conditions ("Terms") outline the rules and regulations for the use of AgentForest's Website and Services, located at agentforest.one and its subdomains (collectively, the "Service").

By accessing this website and using our Services, we assume you accept these terms and conditions in full. Do not continue to use AgentForest if you do not agree to all of the terms and conditions stated on this page.

1. Definitions

  • "Service" refers to the AgentForest platform, websites, APIs, and any associated services provided by AgentForest.
  • "User," "You," and "Your" refer to you, the individual or entity accessing or using the Service.
  • "We," "Us," and "Our" refer to AgentForest.
  • "Content" means text, graphics, images, music, software, audio, video, works of authorship of any kind, and information or other materials that are posted, generated, provided or otherwise made available through the Services.
  • "User Content" means any Content that Account holders (including you) provide to be made available through the Services, including agent configurations, prompts, and data provided to agents.

2. Accounts

When You create an account with Us, You must provide Us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of Your account on our Service. You are responsible for safeguarding the password that You use to access the Service and for any activities or actions under Your password. You agree not to disclose Your password to any third party. You must notify Us immediately upon becoming aware of any breach of security or unauthorized use of Your account.

3. User Responsibilities

You are responsible for Your User Content and any consequences thereof. You represent and warrant that you have all rights, licenses, consents and releases that are necessary to grant Us the rights in such User Content. You agree not to use the Service to create, upload, transmit, distribute, or store any content that is unlawful, infringing, defamatory, obscene, or otherwise objectionable, or that violates any third-party rights.

You are responsible for providing and maintaining your own API keys for third-party Large Language Models (LLMs) or other services that your agents may use. You are responsible for all costs associated with the use of such third-party services through your agents.

4. Acceptable Use Policy

You agree not to misuse the Service or help anyone else to do so. This includes, but is not limited to: probing, scanning, or testing the vulnerability of any system or network; breaching or otherwise circumventing any security or authentication measures; accessing, tampering with, or using non-public areas of the Service; interfering with or disrupting any user, host, or network; sending unsolicited communications, promotions or advertisements, or spam; sending altered, deceptive or false source-identifying information, including "spoofing" or "phishing"; promoting or advertising products or services other than your own without appropriate authorization.

5. Subscription Terms, Payments, and Renewals

Certain features of the Service may be subject to payments now or in the future ("Paid Services"). Please see our Pricing page for a description of the current Paid Services and their costs. All fees are in U.S. Dollars and are non-refundable except as required by law or as explicitly stated. Subscriptions will automatically renew for the same duration as the original subscription term unless you cancel your subscription before the end of the current subscription period. You can manage or cancel your subscription through your account settings or via the payment provider's portal (e.g., PayPal).

6. Intellectual Property

The Service and its original content (excluding User Content), features and functionality are and will remain the exclusive property of AgentForest and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of AgentForest.

You retain all rights to your User Content. By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, copy, reproduce, process, adapt, modify, publish, transmit, display and distribute such User Content in connection with operating and providing the Service.

7. Termination

We may terminate or suspend Your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms. If You wish to terminate Your account, You may simply discontinue using the Service or contact us to request account deletion.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. AGENTFOREST MAKES NO WARRANTIES, EXPRESSED OR IMPLIED, AND HEREBY DISCLAIMS AND NEGATES ALL OTHER WARRANTIES INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT OF INTELLECTUAL PROPERTY OR OTHER VIOLATION OF RIGHTS.

9. Limitation of Liability

IN NO EVENT SHALL AGENTFOREST, NOR ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of [Your State/Country, e.g., California, United States], without regard to its conflict of law provisions.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, You agree to be bound by the revised terms.
